WORK PERMITS

Department of Labor is committed to helping young workers find those positive and early employment experiences that can be so important to their development, but the work must be safe. Youths under 18 years of age must obtain a youth employment certificate (work permit) when employed, even if their parents employ them. The certificate and the issuing instructions are obtained from the N.C. Department of Labor Web site http://www.nclabor.com/wh/youth_instructions.htm.

Automated Youth Employment Certificate system (YECAUTO) can be accessed as follows:

  2. Click on “Youth Employment Certificate” in the Quick Clicks section
  3. Follow the instructions provided
  4. Contact NC Labor office at (919) 807-2796 or 1-800 NC LABOR with questions or problems in using this system

The YECAUTO system works best when youths go online at the place of business for their prospective employer as the employer must provide certain information. You must have Adobe Reader 5.0 or greater to display and print the completed youth employment certificate. Once the completed certificate has been printed out, it must be signed by the youth, a parent and the employer. Parent includes guardian, custodian, or person standing in place of a parent as defined in 29 Code of Federal Regulation (CFR) 570.126. The parent's signature is not required for a youth who has been issued a final decree of emancipation by a court of competent jurisdiction. Once everyone has signed the completed certificate, it is to be given to the employer on or before the youth's first day of work. The certificate is good for as long as the youth works for the same employer even if the youth's job duties change.

If the employer does not have Internet access, youth or parent may enter information using the system. Employer information such as name, address, telephone number, type of business and ABC information is required. Do NOT complete this Certificate until you have a firm job offer.

Minimum Age for Employment and Restrictions:
 
AGE RESTRICTIONS
18 Once a youth reaches 18 years of age, he or she is no longer subject to the child labor/youth employment provisions.
16 & 17 Basic minimum age for employment. Sixteen- and 17-year-olds may be employed in any occupation other than those declared hazardous or detrimental. No youth under 18 years of age who is enrolled in school in grade 12 or lower may be employed between 11 p.m. and 5 a.m. when there is school for the youth the next day. 16/17 year old youths may get the hour restriction waived upon written permission from the parent/guardian and from the youth's principal/designee.
14 & 15 Young persons 14 and 15 years of age may be employed outside school hours in a variety of non-manufacturing and non-hazardous/non-detrimental jobs for limited periods of time and under specified conditions.
Under 14 Children under 14 years of age may not be employed in non-agricultural occupations. Permissible employment for such children is limited to work that is exempt from the FLSA and WHA (such as actors or performers in motion pictures, theatrical, radio or television productions). Children may also perform work not covered by the FLSA or WHA such as completing minor chores around private homes or casual baby-sitting.
